Meeting the Needs of New York State’s Mandatory GHG Reporting
Greenhouse gas emissions reporting supports healthy air quality and addresses the negative effects of climate change in compliance with New York State's Climate Act.
The New York State Department of Environmental Conservation has established new mandatory greenhouse gas reporting requirements under 6 NYCRR Part 253. Stationary combustion and industrial facilities, fuel suppliers, and waste management operations that meet specific emission thresholds must track, record, and report their annual emissions to the state.
While initial emissions data for 2026 is not due until late 2027, facility-specific monitoring plans begin as early as March 1, 2027.
Who Is Required to Report?
Applicability for 2026 reporting is based on your emissions from 2023, 2024, or 2025. If operations exceeded the thresholds in any of those years, you must track data in 2026.
General Reporting Threshold
Facilities emitting ≥10,000 metric tons of CO2e per year
- General stationary combustion and industrial facilities, i.e., owners/operators
- Waste haulers/landfill operators exporting waste out of state
- Anaerobic digestion and liquid storage of waste facilities generating or processing waste
Suppliers and entities (regardless of volume)
- Fuel suppliers delivering natural gas, compressed natural gas (CNG), liquefied natural gas (LNG), liquid fuels, petroleum, or coal into New York State
- Electric power entities
- Suppliers of agricultural lime and fertilizer
Large Emission Source Threshold
Facilities emitting ≥25,000 metric tons of CO2e per year
- General stationary combustion and industrial facilities, i.e., owners/operators
- Waste haulers/landfill operators exporting waste out of state
- Anaerobic digestion and liquid storage of waste facilities generating or processing waste
Fuel suppliers (annual volume thresholds)
- 15 million cubic feet or more of natural gas, LNG, or CNG
- 100,000 gallons or more of liquid fuel or petroleum
- More than 500 U.S. short tons of coal
Facilities that meet the Large Emission Source threshold must also have their annual reports independently verified by a DEC-accredited third party, though exemptions apply for residential-majority buildings, RGGI-regulated facilities, and certain energy/waste sources.
Compliance Schedule & Deadlines
Prior to submitting initial emissions data reports on December 31, 2027 (submitted electronically through the NYS e-GGRT portal), applicable entities must submit initial planning documents.
These include either an Emissions Monitoring and Measurement Plan by March 1, 2027, or a GHG Monitoring Plan by June 30, 2027, depending on the facility type and thresholds.
How We Can Help
AKRF can help facility owners and operators in a number of important ways related to GHG reporting:
- Evaluate 2023-2025 emissions data to determine applicability with Part 253 and identify required filings
- Prepare an Emissions Monitoring and Measurement Plan by March 2027
- Prepare a GHG Monitoring Plan by June 2027
- Assist with account creation, facility registration, and role assignments in e-GGRT portal
- Prepare and submit 2026 annual GHG emissions report by December 2027
- Prepare documentation packages and coordinate with third-party verifiers
- Provide third-party review of GHG reports
